What If a Hospital Patient Cannot Sign Normally?

A hospital patient who cannot write their usual signature may still be able to complete a notarization in California. If the patient can make a mark, California law allows a signature by mark when the required procedures are followed.

- Tell Us Before the Visit: Let Prismark know if the patient cannot write their usual signature or may need to sign by mark.
- Signature by Mark: California permits a person who cannot write their name to sign by making a mark. The signer must be identified by satisfactory evidence, and two witnesses must witness the mark and sign the document.
- Journal Requirement: The signer must also make their mark in the notary journal, witnessed by one person who writes the signer’s name next to the mark and signs as a witness.
- No Hand Guiding: The signer must make the mark themselves. The notary or another person should not physically guide the signer’s hand.
- Patient Participation: A physical limitation does not necessarily prevent notarization. The patient must still personally appear before the notary and be able to communicate directly with the notary as needed to complete the notarization.
- Identification: The patient must have acceptable identification available for the notarization. Ideally, the identification should be unexpired. If the patient’s identification is expired, please let Prismark know before the appointment so it can be reviewed in advance.

What If the Patient Can Only Make a Mark?
If the patient cannot write their usual signature but can make a mark, California permits a signature by mark. Two witnesses must witness the mark and sign the document. One witness writes the signer’s name next to the mark and signs as a witness. The signer must also make their mark in the notary journal, where one person witnesses the mark, writes the signer’s name next to it, and signs as a witness.

What If a Family Member Has Power of Attorney?
A Power of Attorney is a separate issue from signing by mark. If another person will sign in a representative capacity, Prismark notarizes the signature of the person who actually appears and signs.
