Does a Hospital Patient Need to Be Alert and Willing to Sign?

Yes. A hospital patient must personally participate in the notarization and be willing to proceed. The notary must be able to communicate with the patient sufficiently to complete the required notarial act.
Illness, age, or a physical limitation does not automatically prevent a notarization. However, if the patient is unconscious, unwilling to proceed, or appears too confused or impaired to understand what is happening, the notary should not proceed.

Important Information
- Patient Must Be Present: The patient must personally appear before the notary for the notarization.
- Patient Must Be Willing: The patient must be willing to proceed. The notary should not proceed if the patient appears unwilling or is being pressured to sign.
- Patient Must Be Able to Communicate: The notary must be able to communicate with the patient sufficiently to complete the notarization. A family member cannot substitute for the patient’s own participation or willingness to proceed.
- Alertness Matters: A patient who is unconscious, heavily sedated, or too confused or impaired to understand what is happening should not be notarized at that time. If there is any concern, let Prismark know before scheduling.
- Identification: The patient must have acceptable identification available for the notarization. Ideally, the identification should be unexpired. If the patient’s identification is expired, please let Prismark know before the appointment so it can be reviewed in advance.
- Physical Limitations Are Different: Difficulty holding a pen or signing normally does not necessarily prevent notarization. California provides a procedure for signing by mark when the requirements are met.

What If the Patient Is Taking Medication or Is Sedated?
Medication or hospitalization by itself does not automatically prevent a notarization. What matters is the patient’s condition at the time of the appointment. The patient must be able to participate sufficiently in the notarization and be willing to proceed. If the patient is heavily sedated or their alertness varies during the day, let Prismark know before scheduling.Can a Family Member Answer for the Patient?
No. A family member may help coordinate the appointment, provide hospital or room information, and gather documents, but cannot substitute for the patient’s own participation or willingness to proceed. If another person will sign under a Power of Attorney or other legal authority, that is a different signing situation.
