Can Documents Be Notarized in Jail and Then Apostilled for International Use?
By John F. Heinz, Managing Director, Prismark Signature Services
Published: August 30, 2026
Quick Answer
Yes. A document signed by someone in a Los Angeles jail or detention facility may be notarized there and then submitted for a California Apostille when the document and notarization qualify for that process.
The jail notarization must be completed first. The California Secretary of State can then authenticate the signature and seal of the California Notary Public for use outside the United States. An Apostille authenticates the public official’s signature; it does not validate the contents of the underlying document.
Key Takeaways
- The document must first be properly signed and notarized during the in-person jail notary appointment.
- A California-notarized document that qualifies can then be submitted to the California Secretary of State for an Apostille.
- The person in custody does not need to appear at the Secretary of State; another person may submit the Apostille request on their behalf.
- The destination country should be identified before the Apostille request is submitted.
- Not every document follows the same authentication path, so the document type and issuing authority should be reviewed before promising a particular process.
- Prismark can coordinate the jail notarization, California Apostille, and return or international shipping of the completed document when appropriate.

Step 1: The Document Is Prepared Before the Jail Visit
The document should be complete and ready for signing before the notary travels to the jail or detention facility. If an attorney, law firm, business, financial institution, family member, or other professional is responsible for the document, that party should provide the final version and any necessary signing instructions.
Prismark does not prepare legal documents, determine what a person should sign, or advise the signer about the legal effect of the document.
Step 2: The Document Is Signed and Notarized in Jail
The person in custody must personally appear before the California Notary Public and complete the required notarial process. The signer must be satisfactorily identified under California notary law, and the facility must permit the visit and signing activity.
Jail and detention-facility procedures can affect scheduling, access, permissible materials, identification availability, and document handling. Those practical issues should be addressed before the appointment whenever possible.
Step 3: The Notarized Document Is Submitted for an Apostille
After the notarization is complete, an eligible California-notarized document can be presented to the California Secretary of State for an Apostille. The Secretary of State authenticates the signature of the California public official or notary whose signature appears on the document.
The California Secretary of State does not perform the notarization itself. If notarization is required, it must be completed before the Apostille request is submitted.
The Person in Jail Does Not Have to Request the Apostille
The Apostille step can be handled after the jail signing without requiring the person in custody to visit or communicate with the Secretary of State. California permits another individual to submit an Apostille request on someone else’s behalf, and the person presenting the document does not need to be named in it.
This makes it possible for a coordinated service to continue moving the document after the jail notarization has been completed.
What Does the Apostille Actually Authenticate?
Process
An Apostille does not certify that the statements in the document are true or that the transaction itself is legally valid. It authenticates the signature of the public official, the capacity in which that official acted, and, when appropriate, the seal or stamp appearing on the document.
For a qualifying privately prepared document notarized by a California Notary Public, the relevant public official being authenticated is generally the California notary.
Does the Destination Country Matter?
Yes. The country where the document will be used should be identified before the Apostille request is submitted. The California Secretary of State requires the foreign destination country as part of the request. The receiving party abroad may also have its own requirements involving document form, translation, additional certifications, or other acceptance standards. Those requirements should be confirmed with the receiving agency, attorney, consulate, or other appropriate authority rather than assumed by the notary. Can Prismark Handle the Entire Process?
Depending on the document and assignment, Prismark can potentially coordinate the process from beginning to end: receive or pick up the prepared document, arrange the jail notary appointment, complete the notarization, submit the eligible California document for an Apostille, and arrange return or international shipment of the completed document.
This can be especially useful for family members, attorneys, law firms, businesses, or international clients who are not located in Los Angeles and need a local professional to manage the physical document through multiple steps.
Prismark’s Proximity to the California Secretary of State Can Help With Time-Sensitive Apostilles
Prismark is located in Los Angeles with convenient access to the California Secretary of State’s Los Angeles office in the Ronald Reagan State Building. The Los Angeles office currently provides in-person, same-day Apostille service on a first-come, first-served basis, without appointments.
For qualifying California documents, Prismark may be able to facilitate expedited same-day Apostille processing after the jail notarization is completed. Whether same-day completion is practical depends on several factors, including when the jail signing is completed, whether the notarization and document are eligible and ready for submission, California Secretary of State business hours and service availability, wait times at the public counter, the number and type of documents, and any unexpected facility, transportation, or government-office delays.
Because the jail visit must be completed before the Apostille can be requested, same-day Apostille service cannot be guaranteed. When timing and document eligibility permit, however, Prismark’s proximity to the Los Angeles Secretary of State office can make it possible to move a qualifying document directly from the jail notarization into the in-person Apostille process without the delays associated with mailing the document to Sacramento.
