The Advance Health Care Directive should be prepared before the notary arrives whenever possible. A California notary can perform the requested notarization but cannot select, prepare, interpret, or advise the patient which healthcare directive to use.

- Patient Readiness: The patient should be willing to sign, sufficiently aware, and able to communicate directly with the notary. If the patient is heavily sedated, confused, or unable to communicate clearly, let Prismark know before scheduling.
- Advance Health Care Directive: Have the complete document, including all pages, ready for the appointment. The notary cannot choose, prepare, or explain the legal effect of the directive for the patient.
- Identification: Have the patient’s original, acceptable identification ready, such as an unexpired driver’s license, state-issued ID card, or passport. If standard identification is not available, let Prismark know before the visit.
- Do Not Sign in Advance: If the patient’s signature is being notarized, it should be completed as required for the requested notarial act. Let Prismark know if any portion has already been signed.
- Patient Location: Provide the hospital name, building or tower, unit/department, room number, and the name and phone number of the person coordinating the visit.
- Hospital Access: Check for visitor restrictions, security procedures, check-in requirements, or unit-specific access rules before scheduling.
- Witnesses: Some healthcare directive forms may use witnesses instead of, or in addition to, notarization. The notary does not determine which execution method is legally appropriate for a particular directive. Confirm any witness requirements before the appointment.
- Signing Area: If possible, clear a bedside table or other small surface for the document, notary journal, and signing materials.
Why Might an Advance Health Care Directive Be Signed at a Hospital?
A hospitalization may prompt a patient or family to address healthcare decision-making and document the patient’s wishes. The patient may already have an Advance Health Care Directive prepared by an attorney, healthcare provider, or another appropriate source and need a mobile notary to come to the hospital to perform the requested notarization.
What Is the Notary’s Role?
The notary’s role is limited to performing the requested notarization in accordance with California notary law. The notary verifies identity, communicates directly with the signer, completes the notarial act, and records the transaction as required.

What If the Patient Cannot Communicate Clearly?
The notary must be able to communicate sufficiently with the patient to perform the notarization.
