Identification Is Required for the Notarization
A jail or detention setting does not remove the identification requirement. Before completing a notarization, a California Notary Public must have satisfactory evidence of the signer’s identity using a method permitted by California law.
The notary’s role is to evaluate the identification available for the notarial act. A family member, attorney, document preparer, or facility employee should not assume in advance that a particular card, booking record, or other identifier will automatically be sufficient.
The Signer May Not Have Their Usual ID in Hand
People in custody often do not have their wallet, driver’s license, passport, or other personal identification physically available to them. Personal property may be stored by the facility, and access to it can depend on the institution’s procedures.
That does not necessarily mean the notarization cannot be completed. It does mean that the identification issue should be addressed as early as possible so the notary can understand what may be available at the facility.
Custody-Related Identification May Be Available
Depending on the circumstances, a person in custody may have an inmate identification card, another custody-issued credential, or other identification information available through the facility. California notary law contains specific identification provisions, and the notary must determine whether the identification presented is acceptable for the particular notarization.
Because custody systems and identification practices are not identical, Prismark does not assume that every jail uses the same credential or that every custody-issued card will satisfy the notarial identification requirement.
A Booking Number Is Helpful – But It Is Not the Same as Notarial ID
A booking number, register number, or other facility identifier is useful when locating the correct person and coordinating an appointment. Provide it to Prismark when available.
However, a booking number is primarily a facility identifier. It should not be treated as a substitute for satisfactory evidence of identity required for the notarization.
What Should You Tell Prismark Before the Appointment?
When arranging the request, provide the signer’s full legal name, exact custody location, booking or facility identification number if available, and any information you have about the identification the signer may be able to access.
If you have a copy of the document, provide it in advance when possible. Also share the name and contact information of the attorney, law firm, escrow or title company, fiduciary, or other professional who prepared or supplied the documents if questions about the document need to be directed back to that person.
What If Acceptable Identification Cannot Be Established?
If the signer cannot be satisfactorily identified using a method permitted by California notary law, the notary cannot simply waive the identification requirement because the signer is in custody.
The notarization may need to be postponed or the requesting party may need to address the identification issue before another visit is attempted. Facility Information May Still Need to Be Confirmed
Even when the requesting party provides detailed identification information, Prismark may still need to confirm the procedures of the specific jail or detention facility. Los Angeles-area custody systems are not identical, and housing changes, transfers, lockdowns, staffing, or other operational conditions can affect a scheduled visit. Identification that appears to be available before the appointment may also need to be physically presented or otherwise handled according to facility procedures.
